2022 ANNUAL REPORT
Message from the GAPOA Board President
Hello Glen Acres property owners! I hope this finds you all happy, healthy and back to as normal life as possible. Winter has finally let go and the hills are green again!
As most of you know, longtime member and president of the GAPOA Board, Tom Whitt, passed way earlier this year at the young age of 58. His passionate and generous nature; and his extensive knowledge of the subdivision are much missed.
This year's annual meeting was held at the Clifty Community Center on April 9^th^. It was the first in-person meeting since 2019 due to Covid concerns. The 2020 and 2021 GAPOA Annual Reports were mailed out to all members. Copies are available by request at the GAPOA email address below. The Board had hoped to host a potluck social luncheon before the meeting but cancelled due to lack of response by the RSVP deadline. The business portion of the meeting was held as planned and attended by three members (Carrie and Martin Mezzera; and Mike Melroy) and three Board members (Roger Lindvall, Tim Ballard, Mark Oliver, with Troy Branam absent due to work). We appreciate very much those members who came out for the meeting and enjoyed the discussion. We had hoped that including a social aspect to the annual meeting would encourage members to attend but that was not the result. We heard from several members who had made previous plans and could not make it so this year we are announcing the date for the meeting in this report so those members who want to can put the date in their calendars. We are offering to host a potluck lunch again. To avoid Easter weekend, the meeting will be held, rain or shine, Saturday, April 15, 2023 (potluck lunch at 11:30 AM, business meeting at 12:30 PM) at the Clifty Community Center. A notice will be mailed to all members at least 30 days before the meeting. We hope to see you there!
The current Board views itself predominately as the manager of the GAPOA's water system. It uses the authorities and the responsibilities described in the Covenants, Articles of Incorporation, By-Laws, Policy, and Mutual Maintenance Agreement as direct guidance to operate, maintain, and improve the water system and for planning purposes. Copies of these documents are available upon request through our email address. The Board has limited authority to enact policy or respond to issues not related to the water system.
We welcome Tim Fleming to the Board and very much appreciate his willingness to serve! His extensive IT experience and skillset will be very useful.
I am happy to announce that Doug Myerscough, one of our members and a nationally known muralist, has agreed to design a logo and signage for Glen Acres. He has some great ideas and I am looking forward to his results. Thanks Doug!
And finally I would like to express my appreciation for the efforts of the current Board. It is a real honor and pleasure to work with them! I would like to especially recognize Roger Lindvall for his dedication to managing our water system as well as carrying out his duties as treasurer in a timely and thorough manner. He commits a lot of time and effort on our behalf.

2022 Board Member Election
This year's Nomination Committee consisted of Tim Ballard, Mike Melroy and Mark Oliver with Tim serving as Chairman. We had one open position open (the one vacated by Tom Whitt's death) and two nominees for the position: Tim Fleming and Tom McDade. I apologize for any confusion caused by our initial 2022 ballot mailing that incorrectly announced two open Board seats. This was my fault (Mark Oliver). Ballots were mailed to all members based on the number of lots owned. Forty-six (46) votes were cast and Tim Fleming was elected in a close race by 2 votes (24 to 22). We very much appreciate these individuals for their willingness to serve. Welcome to the Board Tim!
Water System Activities/Status
Except for issues related to the extreme cold during the winter of 2021, there were only a few problems with the water system. The float valve on the water tower froze on one occasion and stopped the refilling process for a few days but thawed before there was a major issue. A corroded electrical connection was causing a breaker to throw in the well house on CR 150. Roger found it and repaired it before any serious water shortage occurred. Roger and Will Winn (W.E.T., LLC) replaced a worn-out pump in our chlorinator.
Currently, the Board has contracted Billy Hull to bury the remaining approximately 0.25-mile of sensor line that connects the well to the main tower. This project will complete an effort previously started up but abandoned due to member objection. The exposed line is prone to weathering and breakages and will be much more secure in conduit underground. Mr. Hull has extensive knowledge of our water system infrastructure and has long been a go-to contractor for the GAPOA.
The Board is reviewing and updating the GAPOA By-Laws and will provide them to the membership when the process is complete.
2022 Annual Meeting Discussion Items
As previously mentioned, meeting attendance was sparse but several topics were discussed:
The issue of staying in recreational vehicles during construction of permanent dwellings was raised. The Board has currently, and in the past, taken the stance that this is permissible as long as reasonable progress is being made on the dwelling. If use of the RV is prolonged the Board may consider it installed and be forced to take action.
The issue of water system rights was brought up. The Mutual Maintenance Agreement denotes 5 lots in Glen Acres that are specifically excluded from receiving GAPOA water. Unfortunately for some, the Board cannot authorize extension of water to these lots.
Several members, including Mike Melroy, Roger Lindvall and Mark Oliver helped out with several wildfires in the subdivision. Two of them were either the result of negligence or possibly even intentional. Everyone should be alert for outbreaks and always attend their own fires.
Good news! Roger reported that we can now account for at least 82.5% of our total pumped water in our billing process. This is up from around 60% in 2019. This is the result of locating and repairing leaks and better metering and is due mostly to Roger's focus on the water system since he became a Board member. Once again, thanks!
Meeting with Attorney
Board members Roger Lindvall, Tim Ballard and Mark Oliver met with Attorney Wade Williams to discuss Board authorities and other legal issues. This is a synopsis of the meeting: Because of the accepted interpretation of legitimate residential uses in Arkansas, the Board cannot control the use of houses in the subdivision for rentals, vacation rentals or AirBNB type uses. Currently, water usage in general is not considered excessive (and therefore hastening the need for system augmentation.) The Board cannot pass ordinances to control pet nuisances. Members are asked to reasonably control nuisances their pets may be causing. The Covenants are an agreement between all landowners and not just the purview of the Board. Any member can sue the GAPOA or any other member directly. Changing the covenants would require 100% agreement of all members. It is permissible to allow temporary use of RV's by owners during construction of homes.
